Terms and Conditions

BALR B.V., BALR Retail B.V. and BALR Stores B.V. (hereinafter jointly referred to as: “BALR.”), with their registered office in Alkmaar and principal place of business at Rigakade 20, 1013 BC Amsterdam, the Netherlands, registered with the Dutch Chamber of Commerce under numbers 57910960, 70207143 and 66919924 respectively, were declared bankrupt by judgment of the District Court of Noord-Holland, dated 15 July 2025. Mr. L.E. van Leeuwen, in his capacity as trustee in bankruptcy (hereinafter: the “Trustee”), acts on behalf of the estate(s) of BALR.

Important Information About Your Rights

Sales via the BALR. webshop at www.balr.com (the “Webshop”) qualify as sales from bankruptcy, as they take place under the supervision and with the approval of the Trustee, with the purpose of generating the highest possible proceeds for the estate.

By placing an order through the Webshop, you agree to immediate execution of the agreement and the associated terms regarding your right of withdrawal, as soon as your order has been fully executed. We advise you to carefully consider this before placing an order.

1. Applicability

These general terms and conditions (the “General Terms and Conditions”) apply to all sales via the Webshop. They apply to both consumers and business customers. By placing an order, you accept the applicability of these General Terms and Conditions. Deviations from these terms can only be made in writing and with the approval of the Trustee.

2. Webshop

Images and descriptions on the Webshop are for illustrative purposes only and may differ from the actual product. No rights may be derived from the accuracy or completeness of product descriptions.

3. Limited Product Information

The Trustee is unable to provide further information regarding the condition, functionality or completeness of the products.

4. Special Provisions on the Right of Withdrawal

After payment, all purchases are final. The maximum return period is 14 days. The right to withdraw, return or cancel may be invoked within 14 days of purchase, under the following conditions: return costs are at your own expense. You must email proof of shipment and your order number to returns@balr.com. Upon receipt and inspection of the returned item, and if approved, a refund will be issued.

5. Cancellation by the Trustee

The Trustee reserves the right to cancel any order free of charge before it is shipped. In such a case, the full purchase amount will be refunded.

6. No Warranty or Exchange

Products are sold in the condition in which they are found (“as-is”). No warranty of any kind is provided. Exchange or complaints are not possible, even in case of defects.

7. Order and Payment

Orders are only processed after full payment via the payment methods offered on the Webshop. The Trustee reserves the right to refuse or cancel orders.

8. Price

All prices listed on the Webshop include 21% VAT. Shipping costs, if applicable, are stated and charged separately.

9. No Gift Cards or Vouchers

During the bankruptcy sale, no gift cards or vouchers will be accepted or redeemed as a means of payment.

10. Shipping at Buyer’s Risk

Products are shipped at the risk and expense of the buyer. The Trustee is not liable for damage or loss during transport.

11. Delivery

Delivery normally takes place within one week after receipt of full payment. Due to the bankruptcy situation, this may in some cases take longer.

12. While Supplies Last

Orders are processed in the order of receipt and payment. If a product is no longer available, the purchase amount will be refunded.

13. Customer Service

BALR.’s customer service operates with limited capacity under current circumstances. Questions can only be submitted via email to support@balr.com. Response times may be significantly longer than usual.

14. No Product Reservations

Products are not reserved until paid for. Adding an item to your shopping cart does not constitute a reservation.

15. Privacy & GDPR

Personal data is used solely for order processing and estate administration. Data will be retained for up to one year or as long as required by law or estate management, after which it will be deleted or anonymized. A potential transfer to a successor entity will comply with the GDPR.

16. Applicable Law

These General Terms and Conditions are governed by Dutch law. All disputes may be submitted to the competent court in the Amsterdam district.

17. Other Provisions

Except in cases of intent, gross negligence by the Trustee or mandatory law, any liability is limited to the purchase amount of the product you ordered and paid for via the Webshop.

18. Final Provision

If any provision of these General Terms and Conditions is found to be invalid, the remaining provisions shall remain in full force and effect.
